Ferraro and Associates File Suit Against Pharmaceutical Companies Citing Vaccines Contained Poisonous Mercury 
PR Newswire - USA; May 1, 2002

The law firm of Ferraro and Associates, P.A., announced it has filed one of the first mercury poisoning lawsuits in South Florida against American Home Products and its related companies. The suit was filed March 28 on behalf of Mohamed and Juliet Edoo, the parents of 5-year-old Justin Edoo. The child suffers from toxic neurological effects of mercury poisoning after receiving childhood vaccines containing thimerosal, a highly toxic preservative with high doses of mercury that were administered over a two-year period (December 1996 through December 1998).

The complaint alleges that, despite earlier warnings from the Food and Drug Administration, the pharmaceutical manufacturers and distributors named in the complaint continued to manufacture, distribute, market and sell thimerosal-containing products without any reference to the toxic hazards. The action, which is pending in the Circuit Court of the 17th Judicial Circuit in Broward County, also includes defendants Federico J. Martinez, M.D., the plaintiff's pediatrician who administered the vaccines to Edoo, and Florida Power and Light Company, which discharges and emits mercury into the atmosphere at a facility less than 50 kilometers from the Edoo's residence. The claim is seeking judgment for damages.

Research as far back as the 1930s indicated concerns about thimerosal and its potential hazard to humans who might be exposed or injected with the substance. In the 1980s the FDA proposed a regulation requiring the removal of thimerosal from all over-the-counter products due to safety concerns. In June 1999, the FDA announced, "infants who received thimerosal-containing injections at several visits may be exposed to more mercury than recommended by federal safety guidelines for total mercury exposure." One month later, the American Academy of Pediatrics issued a notice to its members stating a preference for thimerosal-free vaccines.

"It was no secret that vaccines containing thimerosal were dangerous," said James L. Ferraro, sole shareholder of Ferraro ? Associates. "As the use of these thimerosal-laden vaccines increased so did the number of neurological disorders such as autism. At one time only one in 10,000 children were diagnosed with autism, now the rate has climbed to 40 per 10,000 and in some areas of the country, one in 150."

Ferraro ? Associates is part of a coalition of firms from around the country that are bringing these mercury poisoning cases to trial. Edoo v. American Home Products, et al, is only the second such case to be filed in South Florida. Ferraro also is handing nine other mercury-poisoning cases in South Florida, which his firm plans to file in June.

    Vaccine manufacturers have paid out nearly $2B in damages to parents in America whose children were harmed by one of the childhood jabs such as the MMR (measles-mumps-rubella) or DPT (diphtheria-pertussis-tetanus). In all, around 2,000 families have received compensation payments that have averaged $850,000 each. There are a further 700 claims that are going through the pipeline. None of the claims is for autism as medical researchers say they have failed to find a link between the disease and the MMR vaccine, despite the initial findings made by Dr Andrew Wakefield. Instead they are for a wide spectrum of physical and mental conditions that are likely to have been caused by one of the vaccinations. Around 7,000 parents have filed a claim of an adverse reaction with America's Vaccine Injury Compensation Program (VICP). To win an award, the claimant must prove a causal link to a vaccine.     —AANP Position on CHILDHOOD VACCINATIONS:

    —WHEREAS all physicians are ethically obliged to give parents accurate and current information on both the benefits and risks of childhood vaccinations, i.e., parental "informed consent", such as required by the public health clinics of the United States Public Health Service; and,

    —WHEREAS it is well documented that some of the current childhood vaccinations have been associated with significant morbidity and are of variable efficacy and necessity.

    —THEREFORE BE IT RESOLVED that it is the position of the AANP that:

    —I. Safer, more effective vaccinations should be developed, and more research should be conducted on possible short-term and long-term adverse effects of vaccines currently in use.

    —II. All physicians should be attentive to the proper use of vaccines, avoid their administration to individuals with conditions that contraindicate their use, and accurately chart the vaccination, including parental refusal for any vaccines and any adverse effects.

    —III. All physicians should obtain from parents signed informed consent by providing printed information describing the risks of the infectious diseases, the risks and benefits of childhood vaccinations and other options. Consent forms describing such information should be provided in a form and manner which would allow responsible parents to make informed decisions regarding the vaccination of their children.

    —IV. All physicians should respect that the parents or guardian have both the responsibility and freedom to decide within the range of options provided for by state law whether or not their children should receive vaccinations.

    — I was born in New Orleans, Louisiana — second of four children. Always a high achiever, I participated in every extracurricular activity that I could. I married Donald Cave, attorney, after graduating from LSU with a B.S.in Medical Technology in 1966. I had "several" careers including medical technologist, research specialist, instructor of clinical chemistry. The present one, physician, I hope is the last. I went back to Medical School at age 36 after having three children, fulfilling a dream I had had for years. I graduated in 1983 and completed a residency in Family Practice in 1986. Board certified in Family Practice, I have been in the private practice of Medicine in Baton Rouge, Louisiana since 1986. My practice was a typical family practice until the last couple of years. I now enjoy integrative medicine and I spend my time mapping out and normalizing chemistry for my patients. In the last 4 to 5 years, I have treated autistic children. My colleague, Dr. Amy Holmes, and I are seeing more than 700 autistic children. This is where the inspiration for the book started. We realized that there is a link between vaccines and the epidemic of autism that we are seeing.
