CIVIL MANAGEMENT AND CRIMINAL CONSEQUENCES OF VACCINE INJURY

Vaccine injuries can have both civil and criminal ramifications. This
paper explores civil management of vaccine injury for victims seeking compensation
through the National Vaccine Injury Compensation Program and discusses
the potentially devastating consequences that can befall a family when
injuries caused by vaccines are mistakenly attributed to physical abuse
inflicted by a caretaker (Part II) - (Part
I)

Shaken Baby Syndrome
A. The Causal Link, Generally
According to Australian researcher Viera Schiebner, Ph.D., there has
been a recent epidemic of the so-called "Shaken Baby Syndrome," (SBS) and
"[m]any infants who suffer [from it] may be victims of undiagnosed vaccine
damage." Dr. Schiebner finds the vaccine damage explanation more probable
than the proposition that the unprecedented increase in the syndrome is
due simply to an increase in the number of people who are capable or desirous
of hurting or killing babies. She has provided expert reports for a number
of attorneys representing defendants accused of SBS. Upon reviewing the
medical records in these cases, she found that in every one, the symptoms
appeared shortly after the child had received a routine immunization.
Until recently, most vaccine deaths have been labeled "Sudden Infant
Death Syndrome," especially if obvious symptoms were minimal. But with
alarming frequency, one parent—usually the father—is accused of shaking
the baby to death. Ironically, the parent may even "confess" to shaking
the baby, having done so upon finding the baby not breathing or unconscious,
and hoping to revive it. According to Scheibner, some defendants in SBS
cases have won in court based on experts’ reports showing vaccines to be
the cause of the injuries or death. But where the accused caregiver is
uneducated, has a criminal record, or where a vaccine injury is accompanied
by other physical injuries from another cause, the defendant’s chances
are remote. Regarding the SBS/vaccine connection, one U.S. social worker
told Dr. Schiebner, "many foster parents are rotting in U.S. prisons. First,
they are forced to vaccinate their charges, and then, when side effects
or death occur, they are accused of causing them."
Medical research acknowledges the ambiguity that may exist when attempting
to distinguish SIDS from child abuse. According to Dr. Scheibner, a 1993
study revealed that making the determination challenges pediatricians,
family physicians, pathologists and child protection agencies. Other research
suggests that there must be findings of blunt impact to the head to eliminate
the possibility of spontaneous intracranial hemorrhaging from a rare vascular
malformation or bleeding disorder. While there is no dispute that some
parents and caregivers cause injuries through mistreatment, Schiebner makes
a compelling case that vaccines should be given careful consideration in
many instances. "Ever since mass vaccination of infants began, reports
of serious brain, cardiovascular, metabolic and other injuries started
filling pages of medical journals." In fact, pertussis vaccine has been
used to induce encephalomyelitis, which is characterized by brain swelling
and hemorrhaging similar to that caused by mechanical injuries, in laboratory
animals. Of course, when laboratory animals develop symptoms and die, it
is not considered coincidental; but when children develop the same symptoms
and die following immunization, one of three things happens: it is considered
coincidental, the parents or caregiver are accused of causing the injury,
or the cause of death is considered unknown and classified as SIDS. Contributing
to this difficulty is the fact that as a result of "immunological intravascular
complexing of particulate antigen," delayed reactions from vaccines are
the norm rather than the exception; that is, most vaccine injuries and
deaths fall outside of the arbitrary medical-legal guidelines set for accepting
the causal link between the vaccines and the injury or death. This, combined
with the above-mentioned ambiguities, makes for a rather difficult case
for defendants, and to be fair, could make for a difficult determination
of the truth of the matter one way or the other even for informed physicians
and juries in many cases.
Many of the classic benchmarks of abuse can also result from vaccination.
Retinal hemorrhages can be caused not only by shaking, but also by vaccines
and by attempts at cardiopulmonary resuscitation in children, which may
be applied to non-responsive children who suffer breathing distress caused
by vaccines. A bulging fontanelle has been documented as being directly
caused by the DPT vaccine. Thrombocytopenia, a blood clotting disorder
characterized by easy bruising and bleeding and which may result in brain
and other hemorrhages, is also a recognized side-effect of vaccines. Add
to this the well-documented common occurrence of seizures following vaccines—which
can cause injurious falls in young mobile children (and which may go unobserved
by parents), and the possibility that vaccine damage may be mistaken for
physical abuse becomes quite tenable.

Congressional and State Legislators that you oppose compulsory vaccination

and drugs on children and adults are springing up rapidly. No fewer than
6 federal laws mandate involuntary drugging of children for "mental health"

Now States are being urged to compell vaccination of little boys with the
same poorly tested vaccine even though they have no chance of getting the
disease it supposedly prevents.
B. A Case Study: The
Story of Baby Alan
Alan Yurko is serving a life sentence plus 10 years for shaken baby
syndrome (SBS). Numerous medical doctors have reviewed his son Baby Alan's
medical records and have concluded that he died of a reaction to the DTaP
vaccine he was given at the age of two months. The baby's medical records
also show that he suffered from multiple rib fractures on the left side
of his body. This was likely from a bone disease due to a severe vitamin
and mineral deficiencies and not from handling the baby too roughly since
one side of body was more effected than the other. There have been several
papers written on this case after a thorough review of the medical records
by knowledgeable and competent medical doctors. This case is finally receiving
the publicity it deserves. An article entitled, "Shaken Baby Syndrome or
Vaccine-Induced Encephalitis? The Story of Baby Alan" by Harold E. Buttram,
MD and F. Edward Yazbak, MD, was the feature story in the Nov/Dec 2000
edition of ICA Review, a journal of the International Chiropractic Association.
Alan Yurko's article, "Non-Traumatic Rib Injuries: A Logical and Statistical
Conclusion in the Case of Alan Yurko," was also published in the same edition.
As an article in the September 2000 Redbook magazine points out, there
are over 25 cases throughout the United States of men in prison for SBS
when the medical records point to an adverse reaction to a vaccination
as causing the premature death of their babies. Alan Yurko is currently
having his mail withheld from him in an attempt to keep him from accessing
information that can help him in his case. Organized medicine is so obsessed
with hiding the fact that it's vaccines are killing our children that it
has resorted to convincing the courts to imprison innocent parents for

Feb. 18, 2003: A pathologist has uncovered evidence that 'shaken baby'
Alan Yurko was killed by medical staff who massively overdosed the infant
with the drug Heparin, only hours before he died. His father by the same
name is imprisoned in Florida for shaking him causing hemorrhage and death.
Heparin is a blood anti-coagulant very similar to Warfarin --a poison which
kills rats by internal hemorrhaging. more

The Facts
Baby Alan Yurko (his father’s name is also Alan) was born September
16, 1997. Labor was induced at 35 weeks due to a deficiency of amniotic
fluid. The mother had many medical problems prior to and during pregnancy,
including a history of colon problems, gestational diabetes, and a group
B streptococcal infection during pregnancy which itself poses a high risk
of infant death. She was sick and lost weight during the pregnancy, placing
the fetus at great risk for nutritional deficiencies and retardation. The
combination of medical concerns "placed a guarded prognosis on the baby
at time of birth."
Baby Alan spent his first seven days in the hospital, with three in
intensive care. During his 10-week life, baby Alan suffered from pneumonia,
respiratory distress, and jaundice. In November of 1997, at about 8 weeks
of age, despite significant contraindications, baby Alan was given six
vaccines simultaneously: DTP, Hib, OBV, and Hepatitis B. Ten or eleven
days later, he developed a high pitched scream and fever, but having been
forewarned of this possibility (these are common vaccine reactions), the
parents did not become overly concerned. This was accompanied by lethargy
and a lack of feeding, a pattern that continued for three days. It culminated
when at one point the baby stopped breathing, at a time when the father
happened to be alone with the baby and his four-year-old daughter. After
the father’s failed attempts to resuscitate the baby, he got a neighbor
to take them to the hospital where the baby was successfully resuscitated.
In total, there were some 20-25 minutes of apnea before the hospital resuscitation.
The baby was transferred to another hospital and put on life support. A
brain scan was interpreted as showing a subdural hematoma (blood clot or
swelling in the outer covering of the brain or spinal chord), one or two
sites of "entraparenchymal bleeding," and pulmonary infiltrates (inflamed
lungs). After 75 hours in the hospital, baby Alan was pronounced dead.
 Alan
Yurko was charged with aggravated child abuse and first-degree murder of
his infant son, Alan; he is now serving a life sentence without possibility
of parole at Washington Correctional Institution in Chipley, Florida. Mr.
Yurko insists that he did not kill his son; rather, he now claims that
his son died from a combination of medical mistreatment and an adverse
reaction to immunizations. Doctors and scientists from 15 countries have
rallied to support Alan’s innocence, as have members of anti-vaccination/pro-choice
groups from around the world.
The medical examiner’s post-mortem findings included: minor contusions
and a small bruise; swollen brain; hemorrhages on both brain hemispheres,
at the base of the brain and over some areas of the spinal chord; bleeding
in one eye; old healing fractures in four ribs on the back left side; and
mildly hemorrhagic, inflamed, congested lungs. Based on these findings,
the medical examiner concluded that the baby died of shaken baby syndrome.
A report analyzing Mr. Yurko’s case was published in the November/December
2000 issue of International Review of Chiropractic (IRC). The authors (Harold
E. Buttram, M.D., a family physician, hospital staff member, and Diplomate
in Environmental Medicine; and F. Edward Yazbak, M.D., a retired pediatrician),
present a chilling and compelling case for Mr. Yurko’s innocence. Following
some 2000 hours of review and research, they concluded that the baby Alan
died of a vaccine reaction. more

Summary of the Trial and Medical Evidence
The state provided four witnesses, including the medical examiner and
a neuropathologist; the public defender provided only one witness, a neuropathologist.
Two of the state witnesses testified twice, making a total of six expert
witness presentations for the state to only one for the defense. It appears
from the record that the state witnesses did not see or study medical records
from the neonatal (first six weeks afterbirth) hospitalization of the baby.
For instance, one state witness denied finding evidence of hypoxia (oxygen
deficiency), yet the hospital records explicitly reported this. The hypoxia
and chronic jaundice could have caused the neurological damage described
by the defense. The state also neglected to mention the prolonged apnea
that preceded the hospital admission, which also could have caused complications
and pathologic findings described by the state, including acute degeneration
of brain cells with reddish discoloration and swelling of the blood vessels.All
four state witnesses agreed that the father was guilty of child abuse,
and that the baby had died of shaken baby syndrome.
The three primary issues at trial were rib fractures, cerebral hemorrhages,
and meningitis. A brief examination of these and other issues follows.

Rib Fractures: Baby Alan had four rib fractures on his back
left side. Callous formations indicated they were old. One callous formation
was larger than the rest, which the state used to argue that the fractures
had occurred at different times, thus indicating a pattern of abuse. Several
factors suggest otherwise:
.
No one saw evidence of external bruising: not grandparents, mother, babysitter,
nor pediatrician at weekly visits;
Rib fractures from trauma are accompanied by internal thoracic injuries
85% of the time; there were none in baby Alan;
The difference in callous formation could indicate a difference in severity
of the injury rather than a difference in time;
Medical research shows a strong correlation between temporary brittle bone
disease (TBBD) and decreased fetal movement during pregnancy (the mother
reported decreased fetal movement during pregnancy), supporting the defense’s
contention that the rib fractures took place during labor before birth.
The mother suffered from chronic oligohydromnios (deficiency of amniotic
fluid), which would have constricted fetal movements. Decreased amniotic
fluid would also explain the retarded development of baby Alan’s kidneys
(found in autopsy), and pulmonary hypoplasia (underdevelopment of the lungs)
that was evident both in a birth video and in symptoms that persisted throughout
the baby’s life;
It was plausible that advanced vitamin C deficiency also predisposed the
baby to rib fractures.

Cerebral Hemorrhages: The defense asserted that cerebral hemorrhages
resulted from insults to the blood vessels caused by the pre-hospitalization
apnea and advanced meningitis. The hemorrhages were all fresh, within 24
hours in the opinion of the defense expert, placing their occurrence after
the final hospital admission. Supporting this conclusion was the administration
of blood thinner at the hospital, in connection with the administration
of intravenous fluids and/or in anticipation of organ harvesting. In contrast,
two state witnesses attributed the bleeding to trauma, and estimated its
origin at two to five days prior to death. This time period, however, overlaps
the three-day hospitalization period, so the state at least implied that
the bleeding could have been post-hospitalization, despite its conclusion
to the contrary.
Meningitis: The defense witness described extensive evidence of
meningitis that was possibly weeks old, clearly originating before the
final hospitalization. The medical examiner denied finding evidence of
meningitis. However, he admitted to not having examined the spinal fluid,
nor did his pathological report describe the meninges (covering around
the brain and spinal chord), which would have provided evidence for or
against a meningitis diagnosis. A second state witness acknowledged meningeal
inflammation, but attributed it to the hemorrhages instead of meningitis.
However, this contradicted his own statement that such inflammation appears
only 3-4 days after a hemorrhage, and he agreed that most of the hemorrhages
found at autopsy were fresh.
Disseminated Intravascular Coagulation (DIC): DIC was allegedly
caused by shaking the baby immediately prior to the final hospitalization;
this was a cornerstone of the prosecution’s case. However, the lab tests
were more consistent with chronic DIC than with acute DIC, according to
a July 1999 study, again suggesting injury long before the final hospital
admission.
The defense’s position was that baby Alan died of "natural causes," based
on several findings, including:
At the time of baby Alan’s final hospital admission he had advanced pneumonia
and meningitis, either one of which might have been fatal, but together
would almost certainly be fatal;
The brain hemorrhages were due to the apnea and meningitis;
There were brain and spinal injuries at or near birth; and
The baby experienced "failure to thrive," evidenced by immature kidneys,
lack of weight gain, nerve degeneration, and severe hypoglycemia.

In the IRC review of the medical evidence and testimony, Drs. Buttram and
Yazbak state that the defense, accurate in every count in their opinion,
put on a "brilliant presentation." They suggest further that the defense
testimony must have been beyond the grasp of the jury, or was otherwise
overshadowed by the prosecution’s six witness presentations to the defense’s
one. It may also be that juries feel compelled to find someone to blame
when an infant dies, and are more likely to blame a parent than to find
fault with medical authorities or attribute an infant death to "natural
causes." Maintaining his innocence to the end, Mr. Yurko refused to plea
bargain—"a courageous act, one which would have been made only by a person
conscious of his own innocence," but he was found guilty nonetheless. Under
these conditions, Florida state law required a life sentence without parole.

None of the witnesses for either side mentioned vaccination as a possible
cause of any of the injuries. Despite this, an analysis of the evidence
shows vaccines as a probable primary cause of baby Alan’s decline and death.

The Vaccine Analysis:

Contraindications: Baby Alan was vaccinated despite contraindications,
including acute infection and prematurity. Drs. Buttram and Yazbak state,
"[a]l most certainly a medical consensus would agree that vaccinations
would have been contraindicated and should not have been given," and "[a]
serious, possibly catastrophic reaction to the vaccines would have been
predictable under these circumstances."

Mechanisms: The IRC report describes two possible mechanisms which,
either alone or in combination, could have initiated a series of events
culminating in death:

Immune Paralysis from the Vaccines:
There are medical studies supporting immune paralysis from vaccination.
One such study found that T-helper lymphocytes of subjects vaccinated with
tetanus dropped to levels seen in active AIDS patients; the implication
of this for baby Alan’s receipt of multiple vaccines are rather alarming.
The IRC authors cite a study that cites 20 references and case reports
that show immune suppression following various vaccines. Baby Alan had
bilateral pneumonia and failure to thrive when he was vaccinated; the resulting
immune suppression could well have led to the spread of the infection to
other parts of the body, including the brain.

Vaccine-Induced Encephalitis:
Pertussis, Hib, and Hep B vaccines either alone or in combination would
be the prime suspects for this. VAERS [Vaccine
Adverse Event Reporting System] reports of Hep B deaths of neonates
document cerebral hemorrhages, pulmonary bleeding, bloody diarrhea, and
blood in upper airway passages; one study catalogued 45 different types
of reactions in medical literature from around the world. Other studies
associate pertussis endotoxin with bleeding and coagulation disorders.
Regarding baby Alan’s retinal hemorrhage, studies dispute the belief that
shaken baby syndrome is the only possible cause, as reported by Dr. Scheibner
and mentioned in Part II, A. above.
Regarding the latency period between the shots and the symptoms of encephalitis
(inconsolable screaming, etc.), the 10-11 day period occurring in this
case is outside of the VICP’s Table Injury Chart time frame of 3-7 days.
The
IRC authors call this time limitation "outdated and unrealistic," and cite
studies to support the longer time occurring in this case. Editorials and
studies dating back to the 1930’s have documented the onset of nervous
system disorders and encephalitis following vaccination ranging from 10
to 13 days after a shot. More recent studies from the 1970’s have shown
encephalitis occurring largely within a three-day period, for reasons unclear
to the authors of the IRC report. One study (perhaps the only one) that
studied the DPT reactions long term was the independent one by Karlsson
and Scheibner, which found clear patterns of stress-induced breathing in
infants following immunization. Peak stress times post-immunization were
days 2, 5, 6, 8, 11, 13-16, and 18-21. These findings support a causal
relationship between the vaccines and baby Alan’s difficulties.

Autoimmune Reaction: The medical legal standard of 3-7 days for
a vaccine reaction excludes an entire category of adverse events, that
of delayed autoimmune reactions. Little is known about vaccine-induced
autoimmunity due to the lack of study of the subject, but one recent review
cites a temporal relationship of two to three months between vaccination
and autoimmune reactions.

Hot Lots: The vaccine lot for baby Alan’s DTaP shot was later discovered
to be a "Hot Lot"—one with a disproportionately high death and disability
rate compared to other lots. Alan’s lot—DTAP81507, ranks as number one
in deaths, and number four in total events reported.

Vitamin C: The 1970’s work of Archie Kalokerinos, M.D., showed a
direct connection between infant mortality following immunization and vitamin
C. In this case, the mother’s weight loss during pregnancy and inability
to take her vitamins almost certainly resulted in vitamin deficiencies,
which would have left baby Alan more vulnerable to the later vaccines.
It would also have contributed to the fractures, as vitamin C is important
in the formation of connective tissue in the bones; a deficiency at birth
could have left baby Alan susceptible to "green stick"
fractures during the stresses of the birth.

Lymphocytosis and Brain Edema: The meningitis "with heavy infiltration
of lymphocytes" and the brain edema may well have been due to the vaccines.
The active component of pertussis has been known as the "lymphocytosis
promoting factor," and brain edema has been found to be "a feature of pertussis-induced
encephalopathy." Three studies reported infants with bulging fontanelles
following DPT vaccination. Here again there is a basis for connecting baby
Alan’s symptoms with his vaccines.

The
case of baby Lucas
Lisa Mullenax and her husband
Alejandro Mendez were accused of killing their three-and-a-half-month-old
Baby Lucas by blunt force trauma to the head (Shaken Baby Syndrome). The
baby suffered from cardiac arrest and apnea on August 27, 2002 and his
father immediately sought the assistance of a neighbor who contacted the
Medical Emergency Service (MES) asking for help. The MES resuscitated the
baby, treated him with epinephrine, and transported him to the Centre Community
Hospital. Lucas stayed about one hour in this hospital, and then he was
airlifted to the Geisinger Medical Center. Lucas was pronounced brain dead
after six days following his arrival to the Geisinger Medical Center. In
the hospitals, several physicians examined Baby Lucas and no evidence of
traumatic injuries to the head was observed. In addition, Lucas’s head
region was examined by CT scans on August 27th and no bone fracture was
found. Lisa and Alejandro were accused of killing their Baby Lucas based
only on the autopsy findings of an old-healed rib fracture and bleeding
in the retina of the eyes, brain, and the subdural space. Visit

Conclusion, Part II
A section of the IRC report summarizing vaccine adverse events as they
may relate to SBS cases generally bears quoting directly:
A NEW SYNDROME EMERGING FROM TRAGEDY?
As yet based largely on observation and a limited but suggestive body
of medical literature, in many cases thought to represent SBS it appears
that we may be witnessing the adverse effects from interactions of highly
potent vaccines given in combination, which potentially include: Hepatitis
B (hemorrhagic vasculopathies, autoimmune reactions, neuropathies), Hemophilus
influenza (hypersensitization), tetanus (hypersensitization), and pertussis
(hypersensitization, brain edema, and hypercoagulability with vascular
inflammation from endotoxin). At least two of the vaccines, (Hib and pertussis),
when given together, have been shown to increase their sensitizing potencies.
Usually within a period of 12 days these interactions bring about a combination
of brain edema, hypercoagulability of the blood, and inflammation of blood
vessels, these in turn resulting in a shearing effect on subdural blood
vessels and subdural hematomas, thus mimicking what is now though to represent
the SBS.

Drs. Buttram and Yazbak conclude their report by pointing to baby Alan’s
pneumonia and viral meningitis and/or vaccine-induced encephalitis: "Shaken
Baby Syndrome has never caused pneumonia and meningitis. Baby Alan died
of a vaccine reaction." Dr. Scheibner and others have reviewed the medical
reports in this case and come to the same conclusion.
The possible occurrence of an epidemic of misdiagnosed Shaken Baby Syndrome
cases is a sobering thought. There is no scientific DNA breakthrough that
can clear these innocent victims’ names with a single test as has occurred
with other wrongly convicted murderers. As demonstrated in the IRC Report,
research exists that could enable proper analysis to determine whether
or not vaccines played a role, but since few doctors and defense attorneys
are knowledgeable about vaccine adverse events, this analysis is very likely
seldom undertaken in SBS cases.
Concluding Remarks
Vaccine injury can have devastating consequences to victims and their
families in both the civil and criminal arenas. On the civil side, it is
reasonable for the government to take action to ensure that only genuine
vaccine injuries are compensated under the NVICP. However, the system as
presently structured makes it difficult if not impossible for many legitimate
victims to get compensation. Extensive program revisions are badly needed.
Meanwhile, the larger problem—recognition of the widespread failure of,
and full extent of the damage from, mass mandatory immunization programs—remains
substantially unaddressed and under-acknowledged. Safe and effective alternatives,
such as homeopathic prophylaxis, continue to remain beyond most people’s
awareness and are not a legal alternative (only traditional vaccines fulfill
state immunization requirements). These conditions perpetuate unnecessary
death and disability, in support of medical politics and pharmaceutical
profits. However, grass roots organizations dedicated to raising awareness
of the vaccine controversy are gaining ground, despite a heavily financed
medical-industrial-complex propaganda-machine that is being increasingly
utilized in attempts to undermine their effectiveness and credibility.
In the criminal arena, genuine child abusers should be given appropriate
psychological or psychiatric help as needed, and be dealt swift justice
if their acts are committed with the relevant mens rea. Nevertheless, evidence
strongly suggests that some so-called shaken-baby-syndrome cases may actually
be misdiagnosed vaccine injuries. These cases need to be distinguished
and managed outside of the criminal justice system (unless we wish to prosecute
those public health officials who have violated laws by approving improperly
tested vaccines, as France has done, and punish those healthcare practitioners
who administer vaccines despite obvious contraindications, as occurred
in the baby Alan case). Defense attorneys and vaccine dispensers need to
be educated about vaccine injuries, to protect the freedom of those who
have committed no wrong (not to mention giving them the "space" to grieve
for their tragic losses), and to bolster the integrity and effectiveness
of our otherwise flawed criminal justice system. Sadly, the blanket denial
of vaccine death and injury by healthcare authorities has the potential
to undermine educational efforts that implicate vaccines as a cause of
death or disability. Thus, educational efforts may be hampered. There’s
probably no way of knowing just how often caretakers are mistakenly accused
and convicted, and no systematic way of getting information to them that
could prevent the conviction or save them on appeal. Still, baby Alan’s
story is getting lots of attention in the alternative and complementary
health circles, and that segment of society itself is growing.
Ultimately, I believe the death and disability caused by vaccines in
the 20th and 21st centuries will be more widely acknowledged,
and vaccines as we know them today will eventually fade from widespread,
mandatory use. Safer, more effective alternatives that support and strengthen
our marvelously complex immune system, rather than intervening and damaging
it, already exist. These eventually will—indeed, eventually must—replace
today’s vaccines.

Many infants who suffer the so-called 'shaken baby syndrome' may
be victims of undiagnosed vaccine damage
"Agreat number of babies now die within days or within two to four weeks
of birth after hepatitis B vaccination, as documented by the records of
the VAERS [Vaccine Adverse Event Reporting
System] [Vaccine Adverse Event Reporting System] in the USA.) So, the
baby stops progressing, starts deteriorating, and usually develops signs
of respiratory tract infection. Then comes the second and third injections,
and tragedy strikes: the child may cry intensely and inconsolably, may
stop feeding properly, vomit, have difficulty swallowing, become irritable,
stop sleeping, and may develop convulsions with accelerating progressive
deterioration of its condition and mainly its brain function.
This deterioration may be fast, or may slowly inch in until the parents
notice that something is very wrong with their child and then rush it to
the doctor or hospital. Interestingly, they are invariably asked when the
baby was immunised. On learning that the baby was indeed "immunised", the
parents may be reassured that its symptoms will all clear up. They are
sent home with the advice, "Give your baby Panadol". If they persist in
considering the baby's reaction serious, they may be labelled as anxious
parents or trouble-makers. So the parents go home, and the child remains
in a serious condition or dies.
Until recently, the vaccine death would have just been labelled "sudden
infant death", particularly if the symptoms and pathological findings were
minimal. However, nowadays, with an alarmingly increasing frequency, the
parents (or at least one of them, usually the father) may be accused of

After the use of cowpox vaccine became widespread in England, a smallpox
epidemic broke out which killed 22,081 people. The smallpox epidemics became
worse each year that the vaccine was used. In 1872, 44,480 people were
killed by it. England finally banned the vaccine in 1948, despite the fact
that it was one of the most widely heralded ´contributions´
which that country had made to modern medicine. This action came after
many years of compulsory vaccination, during which period those who refused
to submit to its dangers were hurried off to jail.
March 2002: The Assembly Bill # 849, 850 without a name or titled, (Mandated
Vaccinations/Emergency Health Powers Act ) was passed under Rep. Greg Underheims
directions. "The Wisconsin Department of Health Services may order any

Hi, my name is Melynda Slay. At 3 months of age my son, Harrison, was
hospitalized with an intussusception(bowel obstruction) a few days after
receiving the rotavirus vaccine, Rotashield. This vaccine was later removed
from the market after more than 99 children sufferred the same life threatening
injury. I am currently trying to find other parents of children who were
harmed by this vaccine. I believe that if we stand together - maybe we
can make a difference.
My son was used as a ginuea pig in a life-threatening vaccine experiment.
This vaccine never should have made it to the market and my son never should
have suffered from this experience. I am really upset with myself. Before
Rotashield, I didn't take the time to research vaccines more before I allowed
them to be given to Harrison. Before Harrison's vaccine injury, I always
believed everything my pediatrician told me. If he said to give Harrison
a vaccine - I was sure this was in my son's best interest. I know better
now. Of the parents I have spoken with so far, 7 of the children sufferred
intussusceptions while others suffered growth delays, constant diarrhea,
severe constipation and in 1 case death - after receiving the Rotashield
vaccination. There are many more families hurt by this vaccine that I have
not yet been able to find. I want to be certain that all of these parents
know about the Vaccine Injury Compensation progam before the 36 month deadline
is reached for filing a claim. Once I receive my judgement from the Vaccine
Injury Compensation program, I plan to deny it so I will be eligible to
file a civil claim against American Home Products. I hope to convince
other parents of children harmed by this vaccine into doing the same thing.

Vaccine Choices
What options are available to parents in their choice about vaccines?
First, parents may decide they want less than the total range of recommended
vaccines. It comes as a surprise to some parents that they can choose to
have one or some vaccines and refuse others. You are responsible for your
child’s health. You are in control. If a child suffers a dramatic and tragic
reaction to a vaccine, it is the parents who must cope with it. The doctors
may be sympathetic, but they are personally uninvolved. They view it merely
as a casualty in the war against disease, if they admit any culpability
at all.
When would a parent choose to give some vaccines and not others? Simply
stated, some vaccines apparently represent a more dangerous threat to the
body than others. This is inferred from the types of immediate, short-term
reactions that we can observe. We assume that those vaccines with the most
dramatic short-term toxicity also pose a more dangerous risk for long-term
reactions, though this has not been proven because no one has studied the
long-term effects of vaccines.
Given that the long-term risks are unknown, parents usually make choices
about individual vaccines based on the history of short-term reactions
they have caused. The pertussis, measles, and rubella vaccines tend to
cause more significant observable reactions than others, though hepatitis
and polio vaccines can also cause serious illness. The most commonly avoided
vaccine is pertussis because by now, after more than sixty years of medical
reports of horrific reactions (deaths, epilepsy, and retardation) from
the whole-cell pertussis vaccine, public fear of the vaccine has mounted.
The fact that many other countries have abandoned the pertussis vaccine
has strengthened the resolve of many parents to also refuse the vaccine.
These parents have held their ground, and many physicians, though they
may not take the same position, admit that a parent’s concern about possible
reactions may be justified, despite the consistent denial of the American
vaccine industry.
Parents can pick and choose from the list of vaccines based on their
own individual family’s needs and their own research. They may decide that
some diseases pose enough danger to their child to risk the adverse effects
of the vaccine. Even a parent who has rejected most vaccines because of
their potential adverse effects may choose to give one or a few individual
vaccines. Typically, tetanus is a disease that concerns many parents. Since
the vaccine causes less immediate severe reactions than others, because
the vaccine always works to prevent tetanus, and because tetanus represents
a life-threatening situation when it does occur, parents who refuse other
vaccines sometimes opt to get the tetanus shots for their child. A parent’s
concern may be greater for a very active child, especially around horses,
since both these factors increase the risk of wounds and exposure to tetanus.
Other families may be considering travel to areas of the world (Asia or
Africa) where polio still exists, and they will consider giving that vaccine
even if they realize that polio does not occur in their own part of the
world.
Typically, parents will avoid and refuse specific vaccines for two reasons.
Either they fear serious vaccine reactions because of a vaccine’s history,
or the disease causes so little concern that the vaccine does not seem
necessary to them. Other diseases represent a greater threat, and parents
may feel more secure giving the vaccine than risking the disease in their
child. When parents make an informed choice, they will be taking responsibility
for their own child’s health care, doing their best to ensure that child’s
safety and future. An informed choice requires information.
Adverse Effects of Vaccines
All of the vaccines have significant adverse effects. These can be
separated into two groups: (a) immediate or short-term reactions that occur
soon after giving a vaccine, and (b) delayed or long-term reactions. Immediate
reactions include fevers, allergic responses, deafness, convulsions, paralysis,
central nervous system disease resulting in temporary or permanent disabilities,
and death. Delayed reactions may be more insidious and less obvious. They
can also result in persistent conditions that include epilepsy, mental
retardation, learning disabilities, and immune system dysfunction.
Adverse events resulting from vaccines may be due to the bacterial toxin
or virus component of the vaccine, or to the chemicals used in the preparation
and preserving of the solution. These chemicals include mercury, formaldehyde,
aluminum, and a variety of other known toxic materials.
Vaccine reactions are notoriously under-reported. Many factors contribute
to the reluctance of physicians to report a vaccine reaction, not the least
of which is outright denial. Self-protection and self-reassurance are other
psychological motives. Physicians do not want to admit that they have caused
a problem. They like to think that their interventions are helpful, not
harmful. They have also been assured and instructed by the vaccine industry
that certain reactions that parents regularly observe, such as brain damage
and death, cannot be attributed to the vaccines. A whole range of bizarre
and pathological behaviors that infants display after they receive vaccines
must have another cause, they argue. It would have occurred anyway, regardless
of the shot.
Short-term reactions
Immediate or short-term reactions following vaccine administration
have been consistently reported in the medical literature since vaccines
have been in common use. Reports of these reactions have caused rebellion
within the populations of various countries, and governments have responsed
in various ways.
In 1975, Japanese parents refused to give their children the pertussis
vaccine after widespread publication of two deaths following vaccination.
The Japanese government changed its policy in response to this protest,
and delayed the recommended age for vaccination until two years. During
the late nineteenth century, individuals in the United States protested
that mandatory smallpox vaccination infringed upon their constitutional
right of personal liberty. The issue was brought to trial and, in 1905,
the Supreme Court upheld the rule that state police power included the
need to protect its citizens from diseases. All cases since then have resulted
in the same conclusion based on this precedent. When European countries
began suspecting that the pertussis vaccine was dangerous, they eliminated
it from the recommended schedule of childhood vaccinations. When parents
in the United States have refused to administer this vaccine to their children,
however, their children have been taken into protective custody by the
state.
The Vaccine Safety Committee, established by the Institutes of Medicine,
has ruled that the evidence proves, or favors, a causal relation between
vaccines and the following adverse effects:
* anaphylaxis (a sudden, potentially life-threatening
systemic allergic response) caused by several vaccines
* polio and death caused by the polio vaccine
* thrombocytopenia (a decrease in the number of
platelets, the cells involved in blood clotting) caused by the measles
vaccine
* death caused by the measles vaccine
* acute arthritis caused by the rubella vaccine
* acute encephalopathy after DTP
* shock and unusual shock-like states after DTP
* chronic arthritis after rubella vaccine
* Guillain-Barré syndrome after DT and polio
vaccines.
Despite the other thousands of reports from countries around the world
- from distraught parents whose children died within hours of a shot, to
physicians convinced that a vaccine resulted in meningitis, or deafness,
or sudden onset of central nervous system disorders - the committee refused
to recognize a causal relation between these events and the recently administered
vaccines. Most types of adverse reactions reported in the medical literature
and through the VAERS [Vaccine Adverse
Event Reporting System]were not recognized by the Vaccine Safety Committee
as having a causal relationship to the vaccines. The list of conditions
that have a suspected link to vaccines includes 44 different types of reactions—conditions
with literally hundreds of reported cases, conditions such as meningitis
and diabetes following mumps vaccine, and subacute sclerosing panencephalitis
(SSPE) after measles vaccine. Other types of reactions, such as deaths
from the pertussis vaccines, are denied. Despite the controversies, the
conclusions of the Vaccine Safety Committee are now used as guidelines
in the award of compensations for vaccine-injured children.
Long-Term Reactions
Deep controversy also surrounds the issue of delayed or long-term reactions,
because these do not have a clear causal link to vaccines. In vaccine-industry
jargon, they are not "temporally related" - that is the definition of a
delayed reaction. For example, how do we know that the increased number
of ear infections in a population of vaccinated children, or in any individual
child, was caused by the vaccine? No one has studied this question. How
do we know that the rise in attention disorders in school-age children
has a relationship to vaccines? It would seem to be a logical conclusion,
but no one has studied vaccinated versus unvaccinated children. Parents
must make judgments in this area based on the experience of other parents
and practitioners whose children and patients have not been vaccinated.
In general, such parents and practitioners agree that their children
are healthier, and suffer fewer recurrent infections, than their vaccinated
counterparts. This may help reassure parents who choose not to vaccinate,
but it obviously carries no scientific weight.
Critics of vaccinations have asserted that vaccines are capable of causing
recurrent infections in children because they weaken the immune system.
They say that the dramatic rise in ear infections, allergies, and asthma
in children can be attributed (at least in part) to the damaging effects
of vaccines. The incidence of asthma, the most serious and life-threatening
of these conditions, has steadily increased in the modern era since the
introduction of vaccines. Just during the period 1980 through 1989 the
prevalence rate of self-reported asthma in the United States increased
38 percent, and the death rate for asthma increased 46 percent (Centers
for Disease Control, 1992). Just in the five years from 1985 through 1990,
projected estimates for asthma’s medical costs increased 53 percent. The
total estimated cost of asthma rose from $4.5 billion to $6.2 billion,
or 1 percent of all US health-care costs (Weiss et al., 1992). This dramatic
increase has been attributed to increased exposure to environmental pollutants,
and to the toxic effect of asthma medications themselves, but the increasing
burden on the immune system caused by vaccines could also be responsible.
One of the most compelling arguments that points to vaccines as a cause
of immune system dysfunction is the dramatic improvement that occurs in
these cases following homeopathic treatment of the vaccine adverse effects.
When a homeopathic doctor sees a child with recurrent infections, respiratory
symptoms, or nervous system disorders which began after a vaccine, a common
treatment protocol includes the prescription of a homeopathic preparation
of the vaccine itself. This serves to antidote the adverse effect of the
vaccine. Dramatic recoveries have been recorded in the homeopathic literature,
including cases of immediate febrile reactions after vaccines and long-term
illness patterns that resolved subsequent to the homeopathic treatment
(Smits,
1995; Schaffer, 1995; Moskowitz, 1991; Moskowitz 1983).
The Institute of Medicine Vaccine Safety Committee identifies various
autoimmune phenomena as well-documented adverse effects of vaccines. Many
of these autoimmune responses to vaccines result in permanent, chronic
disease conditions. The committee’s report acknowledges the repeated incidence
of specific autoimmune diseases triggered by vaccines that attack nerves
and cause destruction of the nerve sheath (myelin). These demyelinating
diseases, such as multiple sclerosis and Guillain-Barré syndrome
(GBS), have plagued the vaccine industry. Reports of their occurrence following
vaccination continue to pour in from around the world. In their attempt
to explain the repeated occurrence of demyelinating autoimmune diseases
that occur as reactions to vaccines, the committee members admit that,
It is biologically plausible that injection of an inactivated virus,
bacterium, or live attenuated virus might induce in the susceptible host
an autoimmune response by deregulation of the immune response, by nonspecific
activation of the T cells directed against myelin proteins, or by autoimmuniity
triggered by sequence similarities of proteins in the vaccine to host proteins
such as those of myelin (Institute of Medicine, 1994).
If autoimmune processes and immunosuppression caused by vaccines can
destroy myelin (GBS) or joints (rheumatoid arthritis), then perhaps other
destructive diseases also may have their origin in vaccination. This is
the concern of various authors who identify cancer (Murphy, 1993) or AIDS
(Curtis, 1992) as possible results of vaccination. Many critics have suggested
taking a much more cautious approach to vaccine campaigns until we know
more about these possible long-lasting devastating effects.
Several studies have examined the effect of vaccines on subsequent illness
patterns in children to investigate whether vaccines can suppress immune
system functions. One study examined the incidence of acute illnesses in
the 30 day period following vaccine compared to the incidence in the same
children for the 30 day period prior to a vaccine. This study showed a
significant and dramatic increase in nonbacterial fevers, diarrhea and
cough in the month following DTP vaccine (Jaber et al., 1988). Children
had a higher incidence of illness after DTP compared to their health before
the shot.
The ability of pertussis and DTP vaccines to stimulate the onset of
paralytic polio provides further evidence that vaccines can promote serious
disease processes and immune system dysfunction. Paralytic polio has occurred
frequently following vaccination. This phenomenon was first reported in
1909. Scattered cases were reported over the next 40 years. Then, during
the polio epidemics of the 1950s, series of cases of polio following pertussis-vaccine
injections were reported around the world, in Australia (McCloskey, 1950;
McCloskey, 1952), the United Kingdom (Hill and Knowelden, 1949; Medical
Research Council, 1956), and the United States (Korn et al., 1952; Greenberg
et al., 1952).
During a recent polio epidemic in Oman the problem of paralytic polio
infection’s onset soon after DTP vaccination occurred again. In this epidemic,
70 children 5 to 24 months old contracted paralytic polio during the period
1988-1989. When compared to a control group of children without polio,
it was found that a significantly higher percentage of these children had
received a DTP shot within 30 days of the onset of polio (43 percent of
polio victims compared to 28 percent of controls) (Sutter et al., 1992).
The mechanism of this provoking effect of vaccination on polio onset has
never been adequately explained, but it seems clear that an immune-suppressing
effect of vaccines must be responsible.
Animal studies have also shown immune-suppressive effects of vaccines.
For example, mice showed an increased susceptibility to infection following
pertussis vaccine (Abernathy and Spink, 1956). Laboratory studies in humans
have revealed evidence of immune system suppression as well. After measles
vaccination certain lymphocyte functions essential in fighting pathogenic
organisms are depressed (Hirsch et al., 1981), and the number of lymphocytes,
a type of white blood cell that fights disease, decreases (Nicholson et
al., 1992). Similarly, measles-mumps-rubella (MMR) vaccine has been reported
to have a temporary suppressive effect on the function of neutrophils,
another white blood cell (Toraldo et al., 1992).
The possible long-term neurologic effects of the vaccines have been
well-documented by Dr. Harris Coulter in his book Vaccination, Social Violence,
and Criminality: The Assault on the American Brain. He delineates a hydra-headed
syndrome of brain insult and injury possibly caused by vaccines. These
effects include allergies, autism, dyslexia, learning disabilities, behavior
disorders, and antisocial syndromes, all attributable to the assault of
vaccines on the body. He postulates that vaccines have a damaging effect
on the developing myelination process of the nervous system in children.
This assault causes an allergic encephalitis (inflammation or infection
of the brain) with widespread effects. That is, the allergic response initiated
by a vaccine injected into the body is capable of causing encephalitis
and brain damage, because the physical development of nerves is disrupted.
Legal Requirements and Exemptions
The United States government takes the vaccine campaign very seriously.
Parents who make an informed choice about vaccines for their children must
contend with compulsory vaccine laws. Conscientious objection to these
laws is not handled liberally by the courts. In 1905 the Supreme Court
ruled that an individual could not refuse the smallpox vaccine on constitutional
grounds of infringement on personal liberty. The court found that an individual’s
personal liberty must give way to the state’s protection of other citizens’
health (Jacobson v. Massachusetts, 197 US 11, 25; 1905).
Since that time, various state courts have ruled that compulsory immunization
statutes cannot be stricken down on constitutional grounds. Every state
has a compulsory vaccination law, though the specific requirements for
individual vaccines vary from state to state. This means that parents or
legal guardians who decide not to give the vaccines will need to seek a
legal exemption from vaccines. These come in three varieties: medical,
religious, and philosophical. Not all states have philosophical exemptions,
so parents in those states must seek either a religious or medical exemption.
Usually the issue of a child’s unvaccinated status will arise upon registration
for school or day care. Schools require an immunization record, and parents
must have proof that their child has been vaccinated, signed by a health
care provider. Schools become involved in the vaccination campaign because
state and local governments receive federal funding for immunization programs.
The federal Public Health Service Act, 42 U.S.C. § 262 requires that
participating governments must have a "... plan to assure that children
begin and complete their immunizations on schedule ..." and "a plan to
systematically immunize susceptible children at school entry through vigorous
enforcement of school immunization laws" (42 C.F.R. § 5lb.204). Specific
exemption clauses are included within each state’s immunization law. When
the exemption is accepted by the school or the health department, the issue
is resolved. If a request for exemption is denied, then parents may appeal
that decision. Parents who continue to have difficulty with school and
governmental authorities may need to seek legal counsel.
Many attorneys and individuals are working to ensure freedom of choice
in the area of child vaccination. One organization in particular, Dissatisfied
Parents Together (DPT), has been instrumental in the passage of legislation
that protects children and their parents (see Appendix B: Resources). If
a parent makes the choice to avoid a required vaccine, then support for
that decision is available.
